Please read these Terms and Conditions carefully before placing an order with us. These Terms and Conditions, together with any other documents referred to herein (unless otherwise stated), set out the terms under which mobile phones and other related devices (referred to herein as “Phone” or “Device”) are purchased by us from you through this website, mobilephonetradein.co.uk (“Our Site”).

These Terms and Conditions explain who we are, how our purchase services will be provided to you, how you or we may change, cancel, or otherwise end the Contract, what to do in the event of problems, and other important information.

You will be required to read and accept these Terms and Conditions when placing an Order and entering into a Contract with us. If you do not agree to comply with and be bound by these Terms and Conditions, you will not be able to place orders through Our Site. These Terms and Conditions, as well as all Contracts, are in the English language only.

In you using our Site and dealing with us, these Terms and Conditions apply together with our Website Use and Privacy Policy and our Data Protection Policy.

1. Introduction and Information about Us:

You can find everything you need to know about us, The Mobile Phone Hut Limited, and our services on our Site and in these Terms and Conditions before you make an offer (Order). 

We also confirm the key information to you in writing when we confirm your Order.

1.3 For the purpose of these Terms and Conditions mobilephonetradein.co.uk or Mobile Phone Trade In or ‘us' or 'we' refers to the owner of the website mobilephonetradein.co.uk 
'you', '‘your' means you a person or entity who wishes to use, uses or has used this website to place a sales order via our website.

2. Orders and formation of Contract

2.1 When submitting an order (an “Order”) to us on our website and sending your Device to us you affirm that:

  • You are a resident of the United Kingdom.
  • You are at least 18 years of age (or if under 18 years, have received permission from your parent/guardian).
  • You are able to enter into a binding contract.
  • We are not responsible for any liabilities or claims resulting due to a breach by you of any of these conditions.
  • You must be legally entitled to sell the device that you send to us, this means the device must belong to you and you agree for ownership to transfer to us at the time we accept your Order as detailed in clause 2.3.1 below.

2.2 Note – sending your Device to us is at your risk – phones should be sent to us addressed as follows:  MP Trade-in, 38 George Street Place, Warminster, Wiltshire, BA12 8QB.

  • We only accept Orders when we have checked them.
  • Sometimes we reject Orders.
  • We charge you if we have to cancel your Order and / or return your Device as detailed below.
  • You are responsible for making sure your Phone details and specification and are accurate.
  • You must own all rights, title and interest in the Device that you offer to sell to us.

2.3 When the Contract is formed:

2.3.1 No part of our website constitutes a contractual offer capable of acceptance. Your Order constitutes a contractual offer.

Your Contract with us is formed, when we receive an order form from   you on our website (an “Order”), offering us to purchase your Device and we have confirmed our acceptance of that Order to you by email to the email address that you have provided in the Order.

Once we have sent you an Order Confirmation will there be a legally binding Contract between us and you for the sale of the Device by you to us.

Our Site will guide you through the ordering process.

Please ensure that you check your Order carefully before submitting it.

If you provide us with incorrect or incomplete information during the order process, please contact us as soon as possible. Where any information is required, it will be stated on Our Site, either in the product descriptions or during the order process, as applicable.

If we cannot process your Order due to incorrect or incomplete information, we will contact you to ask you to correct it or provide the missing information required for us to supply the Goods to you

2.3.2 The Contract is conditional upon us receiving the Device and it being in accordance with these Terms and Conditions, as determined by us, and the Price being determined as follows. 

2.3.3 The estimated payment (the price we agree to pay you for the Device, the “Price”) depends on the condition of the Device, and once payment has been made by us and we have received the Device and confirmed acceptance of your Order in accordance with clause 2.3.1 above, ownership of the Device passes on to us. 

Our estimated price is shown on our Site – this is subject to change at any time and subject to our quoted price being verified when we confirm your Order.

If the Device we receive is different from the specification you place on your order, the order will be processed by us based on the Device received – or, at our discretion the order cancelled and the Device returned to you subject to a £15 return fee. 

If the model is different, we will inform you and agree with you a revised order and price before proceeding.

2.3.4 VAT: The Price is inclusive of any applicable VAT, which will be indicated by us when we confirm the Price to you.

2.3.5 Payment of the Price by us will be made to your designated United Kingdom Pound Sterling bank account as provided by you in your Order and in accordance with clause 8.5 below.

We will not be responsible for making payment to you late or for not paying you if this is due to you not providing us with the required information within a reasonable period of us asking for it; including any valid bank payment details and / or verifications.

2.3.6 The Contract will expire as soon as we purchase, recycle or return your phone fulfilling these Terms and Conditions.

2.3.7 Consumer Rights: If you are a consumer, the Consumer Contracts Regulations 2013 give you certain legal rights and these Terms and Conditions are subject to your legal rights.

You may cancel the Contract without any charge at any point until the time you send us the Device. After this, and after we have entered into the Contract (by our acceptance of the Order as provided herein) you cannot cancel the Contract with us; however, the Contract will be terminated if the Device does not (or you do not) comply with these Terms and Conditions.

When and how we return goods to you:  If you cancel your Order within the terms above, we will return your Device to you by post within 5 days of receipt of your cancellation.

3. Conditions:

3.1 Blocked/barred/blacklisted

We do not buy phones or any Devices that are currently blocked/ barred/ blacklisted NOR any that will be in the future as a result of your ownership and / or possession or use of the Phone or Device. 

If your Device has a PIN or password these must be removed / disabled prior to you sending us the Device.

Data on Your Device: – we do not accept any responsibility for the security, confidentiality or use of data on your Device

We accept no liability for any third party contract relating to the Device, or in relation to any SIM card sent with the Device.

To ensure the Device is not blacklisted or reported stolen or lost, you can check this using the CheckMEND database, www.checkmend.com.

We check every Device received against the National CheckMEND Register which identifies phones that have been lost, stolen, blocked or barred with a red warning confirmation. 

If your Device is found to have a red warning against it, you will have 28 days to contact CheckMEND who will provide advice on how to prove that you are the legal owner of the device. 

You can begin the process by visiting the CheckMEND website at http://www.checkmend.com/uk/.  You will be asked to provide a description of the issue, as well as your certificate ID number which we will provide you with in our notification email. 

By law we are or may be required to dispose of any phone that comes into us like this. In this instance, you will be emailed about this by us and given 28 days to sort the matter after this deadline we will either dispose of the Phone or require you to make a postage payment to us in order for us to get the Phone back to you. This decision will be made by us on a case-by-case basis.

We accept no liability or responsibility for rejecting your Device or not returning your Device to you in these circumstances. 

You will have to repay us the Price and any charges as provided herein if we return or reject/ or dispose of your Device as a result of any above mentioned CheckMEND warning or in any of the other circumstances mentioned above in this clause 3.

A phone can be blocked/ barred/ blacklisted if the phone contract is not paid (if it is on contract), the finance of the phone is not paid (if it is on finance) or if the phone is reported lost or stolen (if it is insured). If you do not know the history of your phone or if you have purchased it from a third party and are not in control of this happening, then please do not send the phone into us. 

Make a note of your devices IMEI and Serial number, the IMEI number and the serial number is unique to each device and can be found on the back of the sealed box. If the box is not sealed you will have to find these details inside settings on the phone.

It is your responsibility to terminate any contracts associated with your device, ensuring any contracts have been honoured, failure to make payments on a handset contract will lead to it being blacklisted and we are unable to accept any device that has been blacklisted.

It is your responsibility to make sure if the Phone is on a contract, it has been paid in full or monthly payments are met, failure to do so will lead to the Phone being blocked/barred/blacklisted and unusable.

It is your responsibility to make sure there is no outstanding finance on the Phone and if there is you agree you are liable to make sure this is paid in full.

It is your responsibility to make sure the Phone is not reported lost or stolen with a network company or an insurance company, which would leave the Phone being blocked/barred/blacklisted.

It is your responsibility to make sure the Phone will not be claimed lost, damaged or stolen via an insurance policy on the phone which again will leave the Phone being blocked/barred/blacklisted.

You are liable for the Phone you sell to us, even if you are selling the Phone in good faith as the formed contract we have is with you, the seller.

Before you sell us the Phone it is your responsibility to make sure you have done all your checks that the Phone will not be blocked/barred/blacklisted in the future.

If we have already paid for your Device and later find it on a blacklist so blocked/barred/blacklisted. You as the seller would be liable for the whole purchase amount and would be legally obliged to reimburse Mobile Phone Trade-In. 

The reimbursement will be the full pay out amount PLUS an additional set handling charge of 25% of the full pay out value. 

Example - Our pay out price for a iPhone 15 pro 128GB was £800.

You would be charged 

Pay out amount = £800

Set handling charge (25% of pay out amount) = £200

Total reimbursement = £1,000.

You also agree to return payment within 7 working days, and we reserve all our legal rights. After reimbursement was received, your device would be sent back to you.

We accept no liability or responsibility for rejecting your item in these circumstances.

We reserve the right to inform the relevant authorities and / or take any action that we are required or allowed to take if there is any suspicion that there is a deliberate attempt to perpetrate fraud or any other crime.

3.2 In relation to certain devices and conditions we may ask for more information to verify the sale. This can include Proof of identity (passport or driving license, both have to be in date), proof of purchase or proof of address (3 months in date from order request date). These are all normal requests in the industry we work in. The information will be then deleted once the transaction is deemed successful and in accordance with our Data Protection Policy. If this information is not provided to us within 7 days of the date of the request, we shall be entitled to reject the Order or to cancel the Contract. You will be asked to pay a £15 payment to cover our costs to get the phone back to you.

4. Device Conditions

We do not accept non UK specification devices. 

The prices we offer to purchase your Device for is based on a number of assumptions for each Grade. If the Device is found not to meet the criteria clearly explained on our website or during testing you may receive a revaluation offer by email, which you can accept, or decline. If you decline and would like the device back you will be subjected to a return fee of £15 which will cover a small admin fee and Royal Mail Special Delivery postage back to your chosen address. We will send through our business bank details at the time for payment.

We will endeavour to make a revaluation offer as soon as reasonably possible and within 5 days of our receipt of the Phone.

4.1 New - Factory Sealed

  • The box has to be factory sealed
  • The IMEI on the box matches that on the phone.
  • The phone should only be sealed by the manufacture and not a third party
  • The phone has to be U.K model
  • The phone is not MDM locked so it does not come with company management software pre-installed
  • It has not been modified in any way.
  • The phone is a genuine product made by the manufacture is not a copy or imitation of the real thing
  • The phone’s sealed box is in adequate condition so no major dents or damage on the box that could affect the device inside.
  • The phone is currently not barred/blocked/blacklisted and will not be in the future this will be checked against the CHECKMEND database.

4.2 New - Boxed Opened

  • The phone must not been activated/set up before
  • The IMEI on the box matches that on the phone.
  • The phone has to be U.K model
  • The phone is not MDM locked so it does not come with company management software pre-installed
  • It has not been modified in any way.
  • The phone is a genuine product made by the manufacture is not a copy or imitation of the real thing
  • The phone is currently not barred/blocked/blacklisted and will not be in the future this will be checked against the CHECKMEND database.

4.3 Used - Good Condition

  • The phone has to be U.K model
  • It has not been modified in any way.
  • The phone is a genuine product made by the manufacture is not a copy or imitation of the real thing
  • The phone is currently not barred/blocked/blacklisted and will not be in the future this will be checked against the CHECKMEND database.
  • The phone must power on
  • It should show only minor signs of use - minor scratching/scuffing (non-frequent/light), no paint loss
  • The phone must have both fully functional hardware and software
  • Passwords and PIN locks have been removed
  • All accounts have been removed (e.g. iCloud, Samsung, Google)
  • The phone's display screen should be fully functional
  • There should be no signs of water damage
  • The phone must be fully functional (everything must work)
  • All connections, sensors and cameras must be working and undamaged
  • The phone should have a battery health of 85% or above
  • The device does not come with company management software pre-installed and therefore the MDM lock status for Apple devices is OFF or the Knox Guard status for Android devices is OFF (e.g. Samsung, Google)

4.4 Used - Poor Condition

  • The phone has to be U.K model
  • It has not been modified in any way.
  • The phone is a genuine product made by the manufacture is not a copy or imitation of the real thing
  • The phone is currently not barred/blocked/blacklisted and will not be in the future this will be checked against the CHECKMEND database.
  • The phone must power on
  • It should show visible signs of use - surrounding casing: scratching/scuffing (frequent), paint loss
  • Passwords and PIN locks have been removed
  • All accounts should be removed (e.g. iCloud, Samsung, Google)
  • The phone's display screen should be fully functional
  • There should be no signs of water damage
  • The phone must be fully functional (everything must work)
  • All connections, sensors and cameras must be working and undamaged
  • The phone should have a battery health of 70% or above
  • The device does not come with company management software pre-installed and therefore the MDM lock status for Apple devices is OFF or the Knox Guard status for Android devices is OFF (e.g. Samsung, Google)

4.5 Faulty

  • The phone has to be U.K model
  • The phone is a genuine product made by the manufacture is not a copy or imitation of the real thing
  • The phone is currently not barred/blocked/blacklisted and will not be in the future this will be checked against the CHECKMEND database.
  • The phone must power on
  • The device is not water damaged
  • I confirm the device is complete with no missing parts and is not broken in half, bent or crushed
  • Passwords and PIN locks have been removed
  • All accounts have been removed (e.g. iCloud, Samsung, Google)
  • The device does not come with company management software pre-installed and therefore the MDM lock status for Apple devices is OFF or the Knox Guard status for Android devices is OFF (e.g. Samsung, Google)

The prices offered on our Site include any applicable tax at the current rate. We reserve the right to change prices at any time without notice, however, if your order has been submitted, then the price quoted for your device will be guaranteed for 14 days. If your Device is not received by us within these 14 days, or does not adhere to our Terms and Conditions, then the current prices will apply (if they have changed during this period) or we may refuse to buy your Device.

We also retain the rights to change our prices offered on the Site due to market conditions.

5. Device-checking by Us

5.1 Every Device received by us is checked against the CheckMEND database to ensure it has not been reported stolen, lost or blacklisted. 

If a Device has been found to have a record that suggests it has been lost, stolen or blacklisted, we have the option to quarantine the device for a period of 28 days and will email you to notify you of this and what to do next. 

The payment of the Price (by us to you) will also be withheld until the CheckMEND database does not show the Device as lost, stolen or blacklisted. However, if you have contacted CheckMEND to prove you are the rightful owner and the device has been cleared from the database within the 28-day quarantine period, then the full original Price will be paid. If it is not removed within 28 days, and it has not been claimed by the rightful owner, by law we must destroy it and you will not receive any payment.

6. Liability and Limits of Liability

6.1 Subject to clause 6.2 below:

6.1.1 We are not liable and cannot be held responsible for any unforeseeable loss or damage that may occur to you or any third party. 

6.1.2 We are not liable if you don't give us information we need.

6.1.3 We only supply services to and deal with consumers based in the United Kingdom.

6.1.4 We will not be liable to you for any loss of profit, loss of business, interruption to business, or for any loss of business opportunity.

6.2 Nothing in these Terms and Conditions limits our liability for death or personal injury caused by negligence, fraud, misrepresentation or any other liability which cannot be legally excluded or limited. Nothing in these Terms of Sale seeks to exclude or limit your legal rights as a consumer including, but not limited to, those explained above.

7. Events outside our control

7.1 We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by events outside our reasonable control or due to our compliance with any applicable laws or regulations.

7.2 Once the sale is completed, if fraud is suspected the details may be passed to the police for further investigation and appropriate authorities for prosecution. If the Device gets Blacklisted after the sale to us due to the aforementioned reasons, we will notify you via email.

8. Payment methods and further details:

8.1 Once payment has been sent by us to your bank account or paid into your chosen PayPal account, we deem the transaction from a trade-in side completed. We can’t guarantee the Device to be returned back in case you request this after payment is completed.

8.2 Without limitation to use of other payment methods, we reserve the right to use the following methods of payment:

8.2.1 on-line banking and / or any bank transfer method to effect payment to your designated bank account.

8.2.2 PayPal, in the event that you have elected this and subject to the terms below.

8.3 If you believe that we have paid you an incorrect amount, please contact us as soon as possible to let Us know.

8.4 If you have chosen to be paid via PayPal, you must have an active PayPal account. We do not take responsibility for payments out to customers that enter incorrect PayPal account details. Please note, you will not be charged any PayPal fees at your end and it is the fastest method of getting paid. We shall not under any circumstances recall or reissue PayPal payments once made.

If payment on the Order form was selected for PayPal, we do not have any control if PayPal decide to hold your funds for a short period this instance is very rare but is dependent on age and usage of the account. This is not a reflection of us but PayPal holding the payment your end for a short period (to protect the sender and receiver of the Payment). 

PayPal may ask you to enter the tracking number, which you should enter on their system either from the receipt from the pre-paid label or the receipt from your postage you paid for. 

PayPal may ask us to confirm we have the item safe and sound and as soon as PayPal let us confirm this, it will be done (as a processed payment will indicate this). 

We are not held responsible if the hold happens and we are not able to take the PayPal payment back or to process to another payment method for you.

8.5 Where possible we endeavour to make all payments within 1-2 working days of receiving your mobile phone or other Device (excluding weekends) subject to meeting our Terms and Conditions. At busy times of the year, we cannot guarantee payment within this period, please allow up to 3 working days (excluding weekends and national holidays).
 
Please ensure your details are correct as we shall not recall or reissue any payments once made. 
 
Upon us making payment to you, all ownership rights for the Device will transfer from you to us, which will complete the sales contract.

9. What you warrant to Us and your Indemnity to Us:

9.1 For the avoidance of doubt you warrant that all information provided to us is truthful and accurate and without error or omission. 

9.2 You warrant that, unless we have agreed to take an “Open-Box” or used Device from you, the Device is free from any Personal Data

9.3 You are wholly responsible for ensuring all information provided by you to us in an Order and within a Submitted Sales Enquiry is truthful and accurate. 

9.4 We cannot be held liable for reasons of relating to any errors or omissions in the information provided by you to us.

9.5 When a device is received, we expect to find the Order ID included in the device package. Failure to do so will increase the estimated processing time of your Order for selling us the Device.

9.6 Indemnity: You shall indemnify us against all liabilities, costs, expenses, damages and losses (including but not limited to any direct, indirect or consequential losses, loss of profit, loss of reputation and all interest, penalties and legal costs (calculated on a full indemnity basis) and all other reasonable professional costs and expenses) suffered or incurred by us arising out of or in connection with:

9.6.1 any breach by you of the Data Protection Legislation, provided that we give to you notice of such claim within a reasonable time of us becoming aware of same and subject always to applicable law, and

9.6.2 any unlawful act, or omission by you in relation to the Contract.

Data Protection Legislation means all applicable data protection and privacy legislation in force from time to time in the UK including the UK GDPR; the Data Protection Act 2018 (DPA 2018) (and regulations made thereunder); the Privacy and Electronic Communications Regulations 2003 (SI 2003/2426) as amended and all other legislation and regulatory requirements in force from time to time which apply to a party relating to the use of personal data (including, without limitation, the privacy of electronic communications).

Personal data means: means any information relating to an identified or identifiable natural person (‘data subject’); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

10. Access to Our Site and Use of Our Site

Please also read the following which apply to your use of our Site: -

  • Data Protection, Policy. 

10.1 We may suspend our Site without notice if we need to. We cannot guarantee our Site will be available all the time. We are not liable for any loss caused by unavailability.

10.2 Access to Our Site is free of charge.

10.3 It is your responsibility to make the arrangements necessary in order to access Our Site.

10.4 Use of Our Site is subject to Our Website Use and Privacy Policy - Please ensure that you have read the terms carefully, that you understand them, and that you agree to them.

11. Changes to these Terms and Conditions

11.1 We may alter these Terms and Conditions from time to time, for example, to reflect changes in relevant laws and regulatory requirements. If we do so, details will be highlighted at the top of this page. If the changes are likely to affect your Order, we will inform you in advance by email and you may contact us to end the Contract before the changes take effect. If you end the Contract for this reason, and have already sent us your Phone, we will return it to you subject to charges and other terms provided herein.

If any part of the current version of these Terms of Sale conflicts with any previous version(s), the current version shall prevail unless we explicitly state otherwise.

12. International Users

12.1 Please note that we only accept Orders and enter into a Contract and accept Devices from within the United Kingdom and from customers resident in the United Kingdom.

13. Your Personal Data

13.1 We use your personal data as set out in our Data Protection Policy.

This can be accessed on our Site.

14. Disputes about the Contract:

14.1 You have several options for resolving disputes with us, including as detailed below, and these are without prejudice to your legal rights.

Our complaints policy. You can contact us by email initially with a complaint and we will endeavour to respond within 5 days to resolve the complaint.

If your dispute is not resolved by email as above you still retain your legal rights to either go to court or enter an alternative dispute resolution process.

15. Other important terms apply to our Contract.

15.1 We cannot transfer our Contract with you to anyone else unless we notify you and get your written agreement.

15.2 You can not only transfer your Contract with us to anyone else.

15.3 Nobody else has any rights under this Contract. This Contract is between you and us. Nobody else can enforce it and neither of us will need to ask anybody else to sign-off on ending or changing it.

15.4 If a court invalidates some of this Contract, the rest of it will still apply. If a court or other authority decides that some of these terms are unlawful, the rest will continue to apply.

15.5 Even if we delay in enforcing this Contract, we can still enforce it later. We might not immediately chase you for not doing something (like paying) or for doing something you're not allowed to, but that doesn’t mean we can't do it later.

15.6 These Terms and Conditions are governed by English law and wherever you live you can bring claims against us in the English courts. If you live in Wales, Scotland or Northern Ireland, you can also bring claims against us in the courts of the country you live in. We can claim against you in the courts of the country you live in.
